Questions to Ask Before Signing an Early Retirement Offer

An early retirement offer can arrive with a large payment, an attractive departure date and a deadline that makes the decision feel urgent.

The most important details may be elsewhere in the package.

The pension could be permanently reduced. The bridge benefit may end at 65. Health coverage could stop months before salary payments do. The release may prevent future claims. A large part of the payment may be taxable, and the employer may reserve the right to stop salary continuance after you find another job.

Before signing, turn every promise in the offer into a written answer.

Why You Should Not Sign Immediately

An early retirement offer can affect:

Some decisions become irreversible after the agreement is signed or the pension begins.

Request enough time to obtain:

  • Employment-law advice
  • Pension analysis
  • Tax advice
  • Retirement-income projections
  • Insurance comparisons

Ask for any deadline extension in writing.

1. What Is the Official End Date of My Employment?

The package may contain several dates:

  • Last day worked
  • Retirement date
  • Termination date
  • End of notice period
  • End of salary continuance
  • Pension-membership end date
  • Benefit end date

Ask which date controls:

  • Pension service
  • Pensionable earnings
  • Vacation accrual
  • Bonus eligibility
  • Health benefits
  • Life insurance
  • EI application
  • Tax reporting

A vague statement that you will “retire effective immediately” may have consequences beyond stopping active work.

2. Is the Departure Voluntary or Employer-Initiated?

The package may describe the departure as:

  • Voluntary retirement
  • Early retirement
  • Mutual separation
  • Voluntary exit
  • Termination without cause
  • Workforce reduction
  • Resignation

The classification can affect:

  • Employment-law rights
  • EI eligibility
  • Pension rights
  • Benefit continuation
  • Release language
  • Re-employment rights

Ask an employment lawyer to explain the effect of the wording.

Do not agree to describe an employer-initiated departure as a resignation without understanding the consequences.

3. What Am I Giving Up by Signing the Release?

A release may require you to waive claims involving:

  • Termination notice
  • Severance
  • Bonus
  • Commission
  • Pension
  • Benefits
  • Disability coverage
  • Human rights
  • Contractual rights
  • Re-employment
  • Stock compensation

Ask:

  • Which claims are being released?
  • Does the release cover unknown claims?
  • Does it affect a disability claim?
  • Does it prevent a pension complaint?
  • Does it include confidentiality or non-disparagement terms?
  • Are there repayment obligations?
  • Does it restrict future employment?

The release should be reviewed by an employment lawyer.

4. What Is the Complete Gross Value of the Offer?

Request a written breakdown showing:

  • Salary continuance
  • Lump-sum payment
  • Termination pay
  • Severance pay
  • Retiring allowance
  • Vacation pay
  • Bonus or commission
  • Pension enhancement
  • Benefit premiums
  • Legal-fee reimbursement
  • Outplacement services
  • Other payments

Do not rely on one total.

Each component can have different tax and legal treatment.

5. What Is the Estimated After-Tax Value?

Ask:

  • How much tax will be withheld?
  • Which tax slips will be issued?
  • Is any amount employment income?
  • Is any amount a retiring allowance?
  • Does an eligible transfer apply?
  • How much RRSP contribution room is required?
  • Will CPP or EI deductions apply?
  • Will more tax likely be owed at filing?

The eligible portion of a retiring allowance generally relates to service before 1996 and may be transferred to the recipient’s own eligible registered arrangement without using ordinary RRSP room, subject to current CRA requirements.

Have a tax professional calculate the expected final result.

6. Can the Payment Be Spread Across Tax Years?

Ask whether the employer will provide:

  • Lump-sum payment
  • Salary continuance
  • Annual instalments
  • Payment beginning in January
  • Direct registered transfers
  • A combination of payment methods

CRA guidance permits a retiring allowance to be paid over one or more years when structured accordingly.

Consider:

  • Marginal tax rates
  • OAS recovery tax
  • Income-tested benefits
  • Employer credit risk
  • Interest on deferred payments
  • Effect of re-employment
  • Estate treatment if you die before all instalments are paid

Any deferred-payment arrangement should be documented legally.

7. Does Salary Continuance Stop If I Find Another Job?

Some agreements provide full salary continuance regardless of re-employment.

Others:

  • Stop payments
  • Reduce payments
  • Convert the balance to a smaller lump sum
  • Require disclosure of new income
  • Continue only certain benefits

Ask:

  • Must I report new employment?
  • What income counts?
  • Does self-employment count?
  • Does part-time work reduce payments?
  • What happens to benefits?
  • Is there a minimum guaranteed amount?

Do not assume you can receive the full package and a new salary simultaneously.

8. Will My Pensionable Service Continue?

Ask the pension administrator and employer:

  • What is my final credited-service date?
  • Does service continue during statutory notice?
  • Does it continue during salary continuance?
  • Are pension contributions maintained?
  • Are final-average earnings updated?
  • Does the package add deemed service?
  • Is the extra service guaranteed under the pension plan?

In Ontario, pension and benefit-plan contributions generally continue through the statutory notice period when termination pay is provided instead of working notice, subject to the applicable rules.

Rights beyond statutory minimums may require legal analysis.

9. What Would My Pension Be If I Decline the Offer?

Request estimates showing:

  • Pension under the buyout
  • Pension at your planned retirement date
  • Pension at the earliest unreduced date
  • Pension if you work one additional year
  • Pension if you work two additional years

For each estimate, identify:

  • Lifetime monthly pension
  • Bridge benefit
  • Pension after age 65
  • Survivor benefit
  • Indexing
  • Guarantee period

This comparison reveals what the package is asking you to surrender.

10. Is the Pension Permanently Reduced?

Ask:

  • What reduction applies?
  • How is it calculated?
  • Is it monthly or annual?
  • Is it permanent?
  • When could I receive an unreduced pension?
  • Does the buyout waive the reduction?
  • Is the waiver reflected in the official pension estimate?

Ontario pension rules permit early retirement during the applicable period before normal retirement, with any adjustment method set out in the plan.

Do not rely on an oral statement that the pension is “fully enhanced.”

11. Does the Offer Include Additional Pension Service?

Ask:

  • How many months or years are added?
  • Does the service count in the pension formula?
  • Does it count toward unreduced retirement?
  • Does it increase the bridge?
  • Does it increase the survivor pension?
  • Is it included in the commuted value?
  • What happens if the plan interpretation changes?

The added service should appear in the official pension calculation.

12. Does the Pension Include a Bridge Benefit?

Ask:

  • What is the bridge amount?
  • When does it begin?
  • When does it end?
  • Is it indexed?
  • Does CPP starting early affect it?
  • Does it continue to my spouse?
  • Is it included in the commuted value?

Separate the temporary bridge from the lifetime pension.

A total pension of $4,500 may fall substantially at age 65.

13. What Survivor Pension Will My Spouse Receive?

Request dollar amounts under each option.

Ask:

  • What percentage continues?
  • Is the bridge included?
  • Is indexing continued?
  • Is a spousal waiver required?
  • What happens if my spouse dies first?
  • Is there a pop-up feature?
  • Is a guarantee period available?
  • Can the election be changed later?

Both spouses should participate in the decision.

14. Can I Take the Commuted Value?

Transfer eligibility depends on:

  • Age
  • Pension plan
  • Pension-start date
  • Employment-end date
  • Pension jurisdiction
  • Plan-specific rules

FSRA notes that terminated members may have options including a deferred pension, LIRA, LIF when permitted, another accepting pension plan or a life annuity, but a commuted-value transfer is not available in every circumstance.

Ask:

  • Is the transfer available?
  • When does the option expire?
  • What amount is locked in?
  • What amount is taxable?
  • Does the value include pension enhancements?
  • Can a copycat annuity be purchased?

15. What Benefits Will I Lose If I Transfer the Pension?

Ask whether the following depend on leaving the pension in the employer plan:

  • Retiree health benefits
  • Dental coverage
  • Life insurance
  • Bridge benefit
  • Indexing
  • Enhanced early retirement
  • Survivor pension
  • Guarantee period

A large commuted value may look attractive while excluding benefits that are difficult to reproduce privately.

16. When Do Health and Dental Benefits End?

Request exact dates for:

  • Drug coverage
  • Dental coverage
  • Vision
  • Paramedical services
  • Travel insurance
  • Dependant coverage
  • Health-spending account

Ask:

  • Do benefits continue through salary continuance?
  • Does coverage end after re-employment?
  • Are premiums employee-paid?
  • Is retiree coverage available?
  • Does the pension election affect eligibility?

Include replacement costs in the buyout analysis.

17. Can Group Life Insurance Be Converted?

Ask:

  • When does group coverage end?
  • Is conversion permitted?
  • What is the deadline?
  • Is medical underwriting required?
  • What premium applies?
  • Can spousal coverage convert?
  • Does coverage continue during processing?

Request the insurance certificate and conversion forms before the deadline.

18. What Happens to Disability Coverage?

Ask:

  • When does short-term disability end?
  • When does long-term disability end?
  • What happens to an existing claim?
  • What if disability begins before departure?
  • What if I am currently on medical leave?
  • Does signing the release affect a claim?

Someone dealing with health concerns should obtain legal advice before signing.

19. What Happens to My Bonus, Commission or Stock Awards?

Ask whether you remain entitled to:

  • Annual bonus
  • Sales commission
  • Deferred bonus
  • Stock options
  • Restricted shares
  • Profit sharing
  • Employee share-purchase benefits

Review:

  • Vesting dates
  • Active-employment clauses
  • Exercise deadlines
  • Forfeiture terms
  • Effect of retirement status
  • Effect of termination classification

These amounts may be significant and may not appear in the headline offer.

20. How Does the Package Affect Employment Insurance?

Ask whether the employer will issue the Record of Employment as:

  • Retirement
  • Shortage of work
  • Voluntary leaving
  • Dismissal
  • Another reason

Service Canada makes the EI eligibility decision.

The wording of the agreement and the actual circumstances of departure can both matter.

Apply promptly and disclose every payment.

21. Can I Work for a Competitor or Start a Business?

Review clauses involving:

  • Non-competition
  • Non-solicitation
  • Confidentiality
  • Intellectual property
  • Customer contact
  • Geographic restrictions
  • Duration
  • Consulting
  • Self-employment

Ask an employment lawyer whether the restrictions are enforceable and how they affect your future plans.

22. Can the Employer Change or Cancel the Offer?

Ask:

  • Is the offer irrevocable until the deadline?
  • Can it be withdrawn early?
  • Is participation capped?
  • Does management approval remain required?
  • Can the departure date change?
  • What happens if too many employees accept?
  • What happens if too few accept?

Obtain all final terms in writing.

23. What Happens If I Die Before All Payments Are Made?

Ask whether remaining payments go to:

  • Estate
  • Spouse
  • Named beneficiary
  • No one

Review salary continuance, instalments and pension payments separately.

Some payments may stop at death while others continue.

The agreement should address this explicitly.

24. Are Legal and Financial Advice Fees Covered?

Some packages reimburse professional fees.

Ask:

  • What maximum is available?
  • Which professionals qualify?
  • Must invoices be submitted before signing?
  • Is reimbursement taxable?
  • Does the employer receive the advisor’s report?
  • When is the claim deadline?

Use independent professionals who represent your interests.

25. What Is the Exact Acceptance Deadline?

Confirm:

  • Date
  • Time
  • Time zone
  • Delivery method
  • Whether documents must be received or sent
  • Whether electronic signatures are accepted
  • Whether an extension is available
  • Whether the pension election has a separate deadline

Do not confuse the buyout deadline with the pension-election deadline.

26. Can I Change My Mind After Signing?

Ask:

  • Is there a revocation period?
  • Can the retirement date change?
  • Can the pension election change?
  • Can a spousal waiver be cancelled?
  • What happens after the first pension payment?
  • Which choices are irreversible?

Assume the agreement is binding once signed unless it clearly says otherwise.
